If it’s the reading that #5 has, that’s not correct, nor is #5′s interpretation. That piece of the TOS is referring to the designs that buyers can use to customize their Flips with — a really cool feature, brought to you by (I think) cafe press. I got my gf a Flip that was customized with a Ernst Haeckel reproduction.
That excerpt is saying that if you upload an image to customize your Flip with, they can take it and use it.
I don’t know where you’re reading that they own your videos.

carefully read the user agreement…it appears Flip owns the rights to all your videos, period. scary.
i own the mino HD, not the one mentioned here. i said they owned the rights, not the videos, but same diff AFAIK.
and i should have said pure digital rather than flip.
from flipshare agreement 4.0.6:

i tried to get the videos off the camera onto my mac without flipshare, i.e. iphoto but there is some kind of frame rate incompatibility that keeps them from playing smoothly. besides, the video quality is teh suck if the video involves motion of any sort, i.e. moving the camera or filming a moving object – complete chop. plus the lights on the Mino’s buttons are so bright it’s hard to look at the display. (it looks like they might have improved this?)

Yeah, where does it say that they own your videos? Please. And why in the Hell would that be scary? It’s not like any serious filmmaker is going to be using these for anything other than home movies. Unless sex is involved, what are those worth?

@1, no, but at Costco last week, next to the Flip HD display, I saw a ~$100 helmet-mounted camcorder that records to a 2GB chip… but then thought I’d rig the mivo to my headlamp, or invest in a little duct tape….
@4, thanks for the tip (truly)… but to clarify, they won’t _own_ it per se, only have right to adapt and use it, and apparently only when you upload content to their site (like so many other video-sharing sites).
